Booking Conditions
All expedition trips within the brochure are operated by INFINITO SUR.
Below are the details of the terms and conditions of the Contract. Please ensure that conditions are read most carefully before booking your holiday with us so that you fully understand the arrangements, services and facilities that we are able to provide in respect of any of our expedition trips.
Expedition trip means a full detail and description of the tour booked included in this brochure.
1. Booking and Payment terms
1.1 After you have read and accepted the condition, you must complete, sign and return the reservation form to us with a check or wire transfer USD in deposit concept. The balance of the expedition trip price will be due 60 days before the departure date. If your reservation form is received by us within 60 days of the departure date, full payment is due before the reservation can be accepted.
1.2 As soon as we have your reservation form, we will forward to you our confirmation invoice with full details of the expedition trip that has been booked.
1.3 By your acceptance of the conditions you acknowledge that all monies paid in anticipation of our confirmation invoice belong to us.
1.4 If the deposit or the balance of the expedition trip is not received by the due date, we reserve the right to cancel your reservation and apply the cancellation charges set out in condition 4 below.
2. INFINITO SUR Tour Prices
2.1 Although we reserve the right to increase or decrease the expedition trips prices at any time due to circumstances beyond our control, as soon as we confirm your booking the price is assured and there will no increase in cost added to the expedition trip price.
2.2 Except in the event of new legislation or imposed regulations, we reserve the right to add to the expedition trip price such reasonable cost as may be necessary, but limit such increase to no more than 10% of the invoice price.

3. Insurance
3.1 It is a condition to be accepted in our expedition trips, that you are fully insured in respect of the risks set out below, due to the dangerous nature of the expedition trip.
It shall be your responsibility to ensure that you are properly insured for the following items:
Medical treatment and repatriation
Hospital benefits
Personal accidents
Trip interruption
Lost or theft personal effects
Emergency evacuation
3.2 If you arrange your insurance policy by your own contact or with other company, it is a condition of the contract that you send us a copy of the policy of insurance affected in relation to the tour.
4. Your Tour Cancellation
4.1 If you wish to cancel your tour, your request for cancellation must be given in writing. To compensate us for administrative charges and other expenses in dealing with your cancellation the following fees will be charged: The fees are calculated from the date we receive written notice of your cancellation, as a percentage of the tour price, including surcharges.
Cancellation more than 120 days from Trip departure -150 USD Fee
Cancellation 120 to 60 days before departure date - loss of deposit only.
Cancellation 59 to 30 days before departure date - 50% of the tour price.
Cancellation less than 30 days before departure date - 100% of the tour price.

5. Cancellation by INFINITO SUR
5.1 If due to unforeseeable circumstances or insufficient demand for an expedition tour we reserve us the right to cancel the tour. In that case such cancellation to be confirmed in writing to you. In this event you may in writing:
a) - Request all monies that you have paid us to be refunded to you in full; or
b) - Purchase an alternative tour paying or receiving (as the case may be) a refund in respect of any price differential.
6. Misconduct on Tour
6.1 We reserve the right in our absolute discretion to restrict or exclude from any activity at any time after the departure date for the duration of the tour any person or persons whose behavior is such that it is likely to cause danger, distress or damage to other clients, property or to any third party.
6.2 By any act of misconduct that is detrimental or prejudicial to any other person or persons on your tour or could jeopardize the health and safety of such persons, then the team leader is authorized to confine you to a "base camp" (a safe and secure location) in the interests of safety and welfare of the others.
6.3 In the event that you have committed acts of misconduct you undertake to indemnify and hold harmless to INFINITO SUR and all persons arising out of or in any way connected with your acts of misconduct.
6.4 Tour Leader Authority: Signing our booking form signifies your agreement to abide by the authority of the leader, who represents INFINITO SUR. The decisions of the leader as to the conduct, itinerary and objectives of the tour is final.
7. Warnings
7.1 You accept and acknowledge that mountaineering expeditions are by their nature likely to involve actual risks and danger to life as a consequence of the hazards of traveling mountainous terrain, accident, illness or other dangers such as but not limited to wild animals and forces of nature. You are urged to give very careful consideration to the personal risks to health and safety.
8. INFINITO SUR Obligations
8.1 We accept responsibility for ensuring that the tour booked with us will be in accordance with the expedition trip agreed in this brochure (or as may be altered or varied in accordance with the conditions) and to a satisfactory standard.
8.2 The price of each expedition includes all the items specified in each itinerary including the costs built in for "extra days". If in any event the expedition is completed prior to the specified calendar dates, due to a successful summit or due to any unforeseen circumstances, INFINITO SUR will provide alternative secondary trips to fulfill our contracted time commitment with each client.
9. Your Obligations
9.1 You undertake:
a) To consult with your General Practitioner in connection with any illness or disability in your booked tour or where the physical exertion may or could induce illness, and also to have a dental examination as near as practicable prior to the departure date.
b) To notify us in writing forthwith if you are suffering (or have suffered) from any medical or dental condition of whatsoever nature that could affect your mental or physical conditions.
c) By signing the booking form you undertake and confirm to us that your mental and physical condition are sufficient and fit for the purpose of joining in and participating in the tour that you have booked.
10. Our Limitation of Liability
10.1 The following provisions set out our entire limitation of liability to you in respect of any breach of our contractual obligations arising under the contract or in connection with this contract, in tort or in law.
10.2 No liability whatsoever will be accepted by us if the Event of Default is caused by or attributable to you; or is caused by or attributable to a third party unconnected with the provisions of the tour you have booked and whose actions or failures were unforeseeable or unavoidable; or is caused by or attributable to force major.
10.3 You shall indemnify and hold harmless against any loss, damage or injury which may be caused to us, our directors, employees, and any other person on tour from and against and in respect of any and all liabilities, losses, damages, claims, costs and expenses arising out of or any way connected with any act, neglect or default committed by or attributable to you.
11. Unforeseeable Circumstance
11.1 If by any reason of any event Unforeseeable Circumstance we shall be delayed in or prevented from performing the Contract and/or from complying with any of the Conditions, the such delay or non-performance shall be deemed to be a breach of the Contract and/or the Conditions and no loss or damages shall be claimed by you from us by reason there of.
Should the exercise of right and obligations under Contract and/or the Conditions be materially hampered, interrupted, or interfered with by any reason of any event of force major then our obligations shall be suspended during the period of such hampering, interference or interruption and shall be postponed for a period of time equivalent to the period or periods of suspension.
